FortVax cold wallet is operated by Taiwan Numerical Powers Co., Ltd. (hereinafter referred to as "the Company"); the following terms (hereinafter referred to as "these terms") apply to FortVax cold wallet access and user transactions using the website or purchased through the website (the FortVax cold wallet regulated by these terms includes the cold wallet entity, software and mobile app). 8. Anti-Money Laundering and Counter-Terrorism Financing Terms <br/>The Company implements relevant anti-money laundering and counter-terrorism financing laws, policies, and procedures, including monitoring suspicious transactions and reporting to regulatory agencies. The Company is required to retain certain information and documents in accordance with applicable laws, policies, and to fulfill its contractual obligations with third parties. The Company hereby expressly reserves the right to retain such information and documents and to disclose such information and documents to government agencies. This provision shall continue to apply even after the legal relationship between you and the Company is terminated:
8.1 To comply with relevant laws and regulations regarding the prevention of money laundering and the fight against terrorist financing, you and/or your affiliates (including but not limited to legal agents, responsible persons, representatives, authorized persons, and actual beneficiaries) agree that the Company may take the following measures in accordance with the relevant provisions of the "Anti-Money Laundering Act" or the "Anti-Terrorism Financing Act" respectively. You and/or your affiliates also agree that any damages or losses incurred by you and/or your affiliates as a result of the Company's implementation of the relevant measures pursuant to this clause shall be borne by you and/or your affiliates, and the Company shall not be liable for any damages:
8.1.1 If the Company discovers that you and/or your Affiliates are subject to economic sanctions, or are identified or pursued by foreign governments or international anti-money laundering organizations as terrorists or groups, the Company may temporarily suspend and terminate the Company's services, these Terms of Use, and all related transactions and business relationships without further notice to you and/or your Affiliates.
8.1.2 The Company may, in the event of regular or irregular review of your and/or your Affiliates' identities or in other circumstances deemed necessary (including but not limited to suspicion that you and/or your Affiliates are involved in illegal activities, suspected money laundering, terrorist financing activities, or media reports that you and/or your Affiliates are involved in any special illegal cases, etc.), require you to provide the necessary information required for the review within 14 days (inclusive) of receiving notification from the Company. If you and/or your Affiliates still fail to comply after the deadline, the Company may temporarily suspend and terminate the Services provided to you, these Terms of Use and all related transactions and business relationships without further notice to you and/or your Affiliates.
9. Governing Law and Jurisdiction:
The interpretation and application of these Terms and Conditions, as well as any disputes arising therefrom, shall be governed by the laws of the Republic of China, and the Taipei District Court in Taiwan shall be the court of first instance.
